Question: If the property of a father is not sufficient to pay the debt inherited, could the children disclaim the inheritance?
There is no such notion as disclaiming an inheritance in Islamic jurisprudence. Because inheritors cannot be held responsible for the debts of the deceased person. Things are different in today’s law, you can disclaim the inheritance to not pay your father’s debts.
